Judge to Gotti Scion: Give Your Mom a Kidney by Monday, or Report to Federal Prison

Well here’s a legal ultimatum you don’t see every day: Donate your kidney, or go straight to prison. That’s the choice facing 39-year-old Gotti crime family scion Carmine Agnello this weekend, as the culmination of what certainly looks from the outside like a classically slimy bit of stalling to get out of reporting for the start of what is meant to be a 15-month sentence for COVID relief loan fraud. After a few similar requests to forestall his punishment under the guise of “my mom needs a kidney,” U.S. District Court Judge Nusrat Choudhury finally made the ruling: Donate or get off the pot. Carmine Agnello has to either prove by Monday that he has undergone the kidney donation surgery, or surrender to the Bureau of Prisons by 2 p.m. Monday afternoon. If he does go through with the donation, then he gets to recover as a free man for a while, before surrendering himself to begin his sentence on Sept. 18, 2026.

If these names feel familiar, it probably means you were a connoisseur of reality trash TV in the mid-2000s, or an obsessive fan of organized crime/mafia gossip or lore. The A&E reality series Growing Up Gotti chronicled the fabulous life of mob wife Victoria Gotti, the daughter of famed kingpin John “Teflon Don” Gotti, as she lived in a garishly decorated New Jersey McMansion with her three confusingly named, incredibly hair-gelled and tanned sons: Frank Gotti Agnello, John Gotti Agnello Jr., and Carmine Gotti Agnello, human beings who somehow pre-dated the debut of Jersey Shore despite looking like lost cast members. Truly, nothing I can say about this series could paint a picture of its obnoxiousness more efficiently than just posting the opening credits. To think that 20 years ago, this was considered an acceptable level of production for your cable reality series. Ah, simpler times.

Growing Up Gotti ran for three seasons on A&E between 2004-2005, and the family has continued drawing tabloid headlines ever since for anything it was involved in. Highlights include the time in the mid-2010s when one of the brothers (John Gotti Agnello) got married, and it was reported that there was a minimum gift requirement of $5,000 for wedding guests, and that the guest list included everyone from John Travolta to seemingly random members of the Goodfellas cast.

Of course, those spiky-haired teens have now become oily-skinned men more than 20 years later; men who in the family mold can’t seem to stop committing crimes. Carmine Agnello pleaded guilty to a series of fraud charges in 2024 connected to applications for COVID relief loans, totaling more than $1.1 million, admitting that he misrepresented the size of his payroll and claimed that he had no criminal record. Fitting, more than $400,000 of that loan money was apparently reinvested into a cryptocurrency scheme, according to federal prosecutors. He then managed to stall on sentencing all the way to mid-2026, when he was finally given a 15-month sentence (so tough!) to serve.

That of course brought us right back to another stalling phase, with Agnello lawyers claiming in the spring that mother Victoria, 63, had developed chronic kidney disease and that Carmine Agnello wanted to donate one of his kidneys to her. The loving mother was naturally very proud of the boy she called her “miracle child” in a letter to the court submitted in March, in which she also questioned whether he committed the financial crimes he pleaded guilty to.

“Your Honor, you want to know what kind of a young man Carmine is?”, Victoria Gotti wrote. “I am sure every parent would say that if asked about their child, ‘Oh, he or she is the best’—but on my life, my upcoming transplant, THAT is the kind of young man my son is. He is there to help anyone. He is kind and generous to a fault. He is giving me the GIFT OF LIFE.”

And then … the desperately needed transplant just didn’t happen for some reason, and Victoria’s new legal representation began downplaying how critically and soon it was needed while Carmine Agnello asked for more reprieves. Federal prosecutors naturally were not so happy about these extension requests, with Assistant U.S. Attorney Charles P. Kelly writing the following: “This is precisely the basis upon which the defendant sought an eve-of-sentencing adjournment in March; and, after obtaining that adjournment, no surgery actually occurred. Needless to say, the government is extremely skeptical of the instant request.”

The great Gotti Kidney Saga continues.

The judge in the case, then, finally decided she’d had enough of the runaround on the topic of this donated kidney. Today, she laid out her ultimatum in terms that I think you’d agree are pretty black and white:

“1) Should the organ transplant procedure occur on or before August 10, 2026, Mr. Agnello shall self-surrender to the Bureau of Prisons by 2:00 pm on September 18, 2026,”

“2) Should the organ transplant procedure not occur on or before August 10, 2026, Mr. Agnello shall self-surrender to the Bureau of Prisons by August 10, 2026 at 2:00 pm.”

I guess we now get to see exactly what a wonderful son you are, Carmine. Don’t disappoint your mother, or your longtime Growing Up Gotti fans! Just go easy on the red wine from now on.
